General Terms and Conditions of Participation in-Person Events (i.e. in-person seminars, Training Courses) and Online Events (i.e. Online Training Courses, Video Seminars)

These General Terms and Conditions apply to all contracts concluded with Mr. Ronald Göthert, Eisenhartstr. 2, 14469 Potsdam (hereinafter referred to as "Organizer"), which have as their subject matter the implementation of an "in-person event” (i.e. in-person seminar, training program) or an “online event” (i.e. online training course, video seminar) offered by him, hereinafter jointly referred to as "Event".

§ 1 Application

(1) Those interested in an event can make a binding registration for an event via the organizer's website www.goethert-methode.de or by e-mail/by post using a registration form. With the binding registration, an event contract for the entire event is concluded if the organizer confirms this accordingly to the applicant/participant (e.g. by sending a confirmation e-mail or an invoice) and the participant fulfills any requirements of the organizer (e.g. for participation in theme seminars). The minimum age for participation in an event is usually 18 years.

(2) The contractual partner of the organizer is the registrant, usually the registered participant. If notified in good time - at the latest one week before the start of the event - the right to participate can be transferred free of charge to a substitute participant, provided that the substitute participant also fulfills any necessary requirements (e.g. for participation in themed seminars).

(3) After complete, successful completion of an event, the organizer may issue a certificate to the participant, which serves as proof of participation.

§ 2 Event fees

(1) The event fees stated by the organizer upon registration are due for payment to the organizer one week before the start of the event without deduction. If registration is made within this one week before the start of the event, the fees are due immediately, at the latest on the day before the start of the event. When booking online events, the fees are to be paid within 14 days, but no later than the day before the start of the event. The fees are to be paid when registering via the website www.goethert-methode.de using the payment methods specified there or, in the case of purchase on account, to be transferred to the bank account specified in the confirmation e-mail or on the invoice or to the PayPal account specified there.

(2) Online IB&P course (German site): In this two-day online course, the two days build on each other. Participation on the first day is a prerequisite for participation on the second day - participation on the second day is only possible if the participant was also present on the first day. There is no right to a refund of fees in case of non-attendance on the first day, neither for the first nor for the second day. In all other respects the regulations of paragraph (3) and § 4 apply.

(3) In the event of cancellation of an event by a participant for any reason, including illness,  the entire event fee is due. There is no entitlement to a refund of a (partial) fee for event dates not attended.

(4) If payment of the event fees is not made on time by the due date, the organizer reserves the right to exclude the participant from the event until full payment has been made, without the obligation to pay lapsing. Until full payment of the event fees, the organizer has a right of retention to any certificates of participation.

§ 3 Rebooking of the contracting party

(1) In-person events: The rebooking of an in-person event to a new date on the part of the contract partner is possible once free of charge up to two weeks before the start of the event under the condition that the organizer offers another presence event corresponding to the initially booked presence event for booking at the time of the rebooking. A rebooking is only possible if the minimum number of participants required for the booked event according to § 5 is not fallen short of.

(2) Any rebooking must be made in text form to the organizer in accordance with § 126b BGB.

 

§ 4 Cancellation / Withdrawal of the Contractual Partner / Termination of the Organizer

(1) In-person events: Registration for an in-person seminar can only be cancelled free of charge by the contract partner up to four weeks before the start of the event. A free cancellation of the registration for a training course on the part of the contract partner is only possible up to six weeks before the start of the event.

(2) Online events: A free cancellation of the registration for an online event on the part of the contractual partner is only possible up to four weeks before the start of the event.

(3) In the event of cancellation of a registration in a shorter period before the start of the event than regulated in paras (1) and (2), 50% of the event fees will be charged; in the event of cancellation of a registration less than one week before the start of the event, the entire event fees will be charged.

(4) In the case of distance selling transactions, the statutory right of withdrawal in § 4a applies (note the early expiry of the right of withdrawal for online events).

(5) Other rights of withdrawal and revocation or termination of the event contract, for whatever legal reason, are excluded for the contractual partners.

(6) The organizer is entitled to terminate the event contract in the event of significant legal or official changes to the general conditions applicable at the time of the conclusion of the contract as well as for important reasons for which the contractual partner or the participant is responsible.

§ 4a Right of withdrawal

The contractual partner who is a consumer within the meaning of Section 13 of the German Civil Code (BGB) has a right of revocation under the law in accordance with Sections 312g and 355 of the German Civil Code (consumer revocation in distance selling transactions). This does not apply to contractual partners who become contractual partners of the organizer on the basis of other transactions, e.g. who register in writing (e-mail, mail, fax). If a person books participation in an in-person or online event online in his/her capacity as a consumer, he/she has a right of withdrawal in accordance with the statutory provisions. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his or her commercial nor to his or her independent professional activity. The following applies to consumers:

You have the right to cancel this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day of the conclusion of the contract. To exercise your right of withdrawal, you must notify us:

by means of a clear declaration (e.g. a letter sent by mail, fax or e-mail) about your decision to revoke this contract. For this purpose, you can use the sample revocation form attached below (also published here), which is, however, not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the revocation

If you withdraw from this contract, we must refund all payments we have received from you immediately and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. If the event begins during the cancellation period, you must pay a reasonable amount after exercising your right of cancellation. Reasonable is the amount that corresponds to the proportion of the services already provided up to that point in time compared to the total scope of the services provided for in the contract. The decisive point in time is the time at which we received the notification of your revocation of this contract.

Premature expiry of the right of withdrawal

The right of withdrawal expires prematurely:

  • with the time when an in-person event begins, should it be earlier than the end of the withdrawal period.

  • for online events, from the time you have access to the complete course material (e.g. as a download) or the event starts, should this be earlier than the end of the withdrawal period.

§ 5 Minimum number of participants / reservation of the right of withdrawal

(1) In-person events: The organizer's in-person seminars will certainly take place if there are at least 16 participants. The organizer’s certification program/professional training will certainly take place with a minimum number of 12 participants.

(2) Online events: The online events of the organizer take place with a minimum of 16 participants.

(3) If the number of participants is lower or decreases, the organizer reserves the right to cancel or postpone the event up to one week before the start of the event.

(4) In the event of cancellation, any fees already paid will be refunded. In the event of last-minute cancellations by speakers or in the event of force majeure, the organizer reserves the right to hold the event with substitute speakers or on another date. Further claims of the contractual partners are excluded.

§ 6 Event / Event schedule and participation / Changes to the event content

(1) Online events: The participant is responsible for meeting the technical requirements for the use of the online event (additional costs for the connection to the Internet may arise). A refund claim of the contractual partner in case of non-functioning technology of the participant is excluded.

(2) Online events: The access links to the online events may not be passed on to third parties or made publicly available by the contracting party/participant. The access to the offer of the organizer is personalized, so that a conclusion on the infringer(s):in this rule is basically possible. Should the organizer become aware that an online event is attended by different persons under the same access link or that an access link has been made publicly available, the organizer shall be entitled to a claim for damages against the infringer(s).

(3) The participant undertakes not to use for commercial purposes or make available to third parties personal data of other participants of which he/she may become aware in connection with an event. In the event of misuse, the organizer reserves the right to take legal action, which would, however, also be possible for the other participants.

(4) The contents of all events are protected by copyright. The participant is not permitted to take screenshots or video captures during the online events or to take photos or video recordings during in-person events.

(5) The organizer reserves the right to change the sequence of the event units in terms of time and content as well as to adapt the content of the event. Claims for repayment of the contracting parties for this reason are excluded.

§ 7 Working documents / Copyright

(1) If applicable, working documents from the organizer will be made available online/digitally in the events. These working documents are protected by copyright and may not be reproduced or used commercially - not even in part - without the written consent of the organizer and the respective speakers.

(2) Insofar as content is made available online/digitally (e.g. in PDF format, as video or audio recordings) (e.g. by e-mailing, streaming or downloading), participants do not receive ownership thereof. They receive the simple, non-transferable right to use the digital content for exclusively personal use in accordance with copyright law in the manner offered in each case. The digital content may be downloaded and printed out once for personal use and copied exclusively onto the participant's own end devices. It is not permitted to copy the digital content for third parties, to make it publicly accessible or to forward it, to post it on the Internet or in other networks, whether for a fee or free of charge, to imitate it, print it, resell it or use it for commercial purposes, or to change the content in any way in terms of content or editing or to use modified versions. It is also not permitted to pass on the corresponding online access data to third parties.

(3) The organizer assumes no liability for the contents of the events or the accompanying working documents, provided that there is no intentional or grossly negligent fault of the organizer or a vicarious agent of the organizer.

§ 8 Liability

Each participant is responsible for what he/she does, receives, gives and experiences during the event. The organizer is liable for his own fault and the fault of his legal representatives and agents only in case of intent and gross negligence. Any further liability - irrespective of the legal basis - is excluded. This does not apply to claims for damages by the participant arising from injury to life, body or health that are based on a breach of duty by the organizer.

§ 9 Data protection

With regard to data protection, reference is made to the separate data protection declaration of the organizer, which can be accessed online at www.göthert-methode.de.

§ 10 Place of Performance / Jurisdiction

Place of performance and jurisdiction is - as far as permissible - Bad Reichenhall.

§ 11 Consumer Dispute Resolution / Universal Dispute Resolution Body

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
